Privacy Policy

1.  Introduction

This Privacy Policy applies to all information collected  by us or disclosed by you to us via the Eric the Circle website or  mobile application (the term ‘Site’  as used throughout this policy includes both mobile applications and the internet ) operated by Eric the Circle Pty Ltd (Eric or we or us). This Privacy Policy sets out the nature of the information collected by Eric and the use to which we are entitled to use that information.

Eric is committed to protecting the privacy of your Personal Information (defined below in clause 2). Eric regards its obligations under the Privacy Act (Cth) 1988 (the Privacy Act) as extremely important and its actions are directed at complying with the Privacy Act. Eric will not deal with your Personal Information collected by us other than in accordance with this Privacy Policy.

Eric may, from time to time, modify this Privacy Policy to reflect changes:

(i) to the law;

(ii) to the types of personal information collected by us; or

(iii) in the manner of use of personal information.

We will notify you of any material changes to our Privacy Policy no later than when such changes become effective. Your continued use of the Site is evidence of your agreement to both this Privacy Policy and any changes made to this Privacy Policy.

This Privacy Policy should be read in conjunction with the Terms of Use which you also agree to be bound by when you register with the Site. Terms defined in the Terms of Use that are capitalized on this Privacy Policy have the same meaning as in the Terms of Use.

2.  We may collect Personal Information

When you register with Eric, you are required to provide certain personal information to us as part of the registration process. This information may include your email address, telephone number(s) and your mailing address and the creation of a screen name. If you are not willing to provide the required information, then you will not be able to register with the Site.

Eric may also collect more general information about you, such as what magazines or periodicals you subscribe to, your interests and whether you participate in any social networking sites. 

The above information is collectively referred to as Personal Information in this Privacy Policy.

Eric may also collect non-personal information such as your IP address, the number of visitors and visits to the Site, including the date and time of those visits, the number of pages viewed and navigation patterns. This information is obtained using ‘cookies’ that are often used by websites to identify users computers.

3.  How we store Personal Information

Eric maintains all Personal Information collected from the Site in secure databases and in a web-hosted environment that is fire-walled.

4.  How we use your Personal Information

We may use your Personal Information to provide you with services and information offered on the Site, and from time to time to provide you with information about goods and services offered by advertisers, sponsors or other third parties on the Site.

We will also use your Personal Information to provide you with services that you have requested be provided to you on the Site by Eric 

Eric may also use your Personal Information for planning research, product development and strategic or other business purposes in relation to products, services or information offered, or which Eric may offer, on the Site or in its business operations or in the business operations of its Suppliers.

5.  How we disclose your Personal Information

We will disclose your Personal Information to Suppliers (defined below) for the purpose of enabling Eric or those Suppliers to provide goods, services and information on the Site.

We may also disclose your Personal Information to Suppliers for the purpose of enabling our Suppliers to use your personal information:

(i) to provide you with goods, services and information supplied by the Suppliers in accordance with the Suppliers’ privacy policies; and

(ii) for the purpose of planning, research, product development and strategic, financial or other business purposes.

For the purposes of this Privacy Policy, the following defined terms apply:

Suppliers means third party suppliers with whom Eric has entered into agreements or arrangements with from time to time to supply goods, services and information to Eric

6. Direct marketing

We will use your Personal Information for the purposes of providing you with information, and for the purposes of our Suppliers supplying you with information, about our respective goods and services.

7. Access to Personal Information

If you wish to access the Personal Information about you that is held by Eric, please contact us in writing at info@ericthecircle.com. We may ask you to provide proof of identity when making a request and you may be charged an administration fee when we provide you with the information to cover our time and, if posted to you, our postage and handling costs.  

If we are unable to provide you with your Personal Information or Digital Personal Information, we will notify you in writing of the reason(s).

8. Updating Personal Information

You should ensure that any Personal Information you provide to Eric is accurate and up-to-date. If you think any Personal Information is not accurate, complete and up-to-date, you may ask us to correct this information. We will take reasonable steps to correct such Personal Information unless we disagree with you about whether the Personal Information is accurate, complete and up-to-date.
